What must a payment claim contain under the BIF Act (Qld)?
Under section 68 of the Building Industry Fairness (Security of Payment) Act 2017 (Qld), a payment claim must be a written document that identifies the construction work or related goods and services it relates to, states the amount claimed, and requests payment of that amount. It no longer has to say it is made under the Act.

Security of payment timeframes in Queensland: a dated reference
In Queensland, a respondent has 15 business days to give a payment schedule. Payment falls due 10 business days after the claim if the contract is silent, capped at 15 business days for commercial building contracts and 25 for subcontracts. Adjudication applications run 20 or 30 business days depending on what came back.

What is a payment schedule, and what to do when it comes back short
A payment schedule is the respondent's written response to a payment claim. It must identify the claim, state the amount they propose to pay, and, if that is less than claimed, say why, including their reasons for withholding. In Queensland they have 15 business days. If it comes back short you have 30 business days to apply for adjudication.

An extension of time notice tells the other party that a delay event has occurred, when it started, what caused it, and what effect it has on the date for practical completion. In most Queensland subcontracts the notice period is a condition precedent: give it late and the entitlement is lost, however genuine the delay.
